Terms of Service

By accessing or using the website thepoint.am and the services provided by The Point Marketing Agency ("The Point", "we", "us", or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our website or services.

The Point Marketing Agency provides digital marketing, branding, social media management (SMM), search engine optimization (SEO), pay-per-click advertising (PPC), UI/UX design, web development, and website management services.

The specific scope, deliverables, timelines, and pricing for each project are defined in a separate proposal or service agreement signed by both parties.

As a client, you agree to:

• Provide accurate, complete, and timely information required for project delivery
• Review and approve deliverables within agreed timeframes
• Ensure you have the rights to any materials (logos, images, content) provided to us
• Make payments according to the agreed schedule
• Communicate changes or feedback through agreed channels

Client Materials: You retain ownership of all materials you provide to us for use in your project.

Deliverables: Upon full payment, you receive ownership of the final deliverables created specifically for your project, as outlined in the service agreement.

Our Tools & Processes: We retain ownership of all proprietary tools, templates, methodologies, and processes used in delivering our services.

Portfolio Rights: Unless otherwise agreed in writing, we reserve the right to display completed work in our portfolio and marketing materials.

Payment terms are specified in each individual service agreement or proposal. General terms include:

• A deposit (typically 50%) is required before project work begins
• Remaining balance is due upon project completion or as outlined in the agreement
• Late payments may result in project suspension until payment is received
• All fees are non-refundable unless otherwise stated in the service agreement

Each project includes a set number of revision rounds as specified in the service agreement. Additional revisions beyond the agreed scope may incur extra charges. Significant changes to the project scope after work has commenced may result in revised pricing and timelines.

Both parties agree to keep confidential any proprietary or sensitive information shared during the course of the engagement. This includes business strategies, financial data, client lists, and any information marked as confidential. This obligation survives the termination of the agreement.

To the maximum extent permitted by law, The Point Marketing Agency shall not be liable for:

• Indirect, incidental, or consequential damages arising from use of our services
• Loss of profits, revenue, data, or business opportunities
• Results from third-party platforms (Google, Meta, Instagram, etc.) that are outside our control
• Delays caused by client failure to provide required materials or approvals

Our total liability for any claim shall not exceed the total fees paid by the client in the three months preceding the claim.

We strive to deliver high-quality work, but we do not guarantee specific marketing results such as a particular number of leads, sales, or search rankings, as these depend on many factors outside our control.

Our website and services are provided "as is" without warranties of any kind, express or implied.

Either party may terminate a service agreement with written notice as specified in the agreement. Upon termination:

• The client is responsible for payment of all work completed up to the termination date
• We will deliver all completed work product upon receipt of final payment
• Both parties remain bound by confidentiality obligations

These Terms of Service are governed by the laws of the Republic of Armenia. Any disputes arising from these terms or our services shall be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to the competent courts of the Republic of Armenia.

We reserve the right to update these Terms of Service at any time. Updated terms will be posted on this page with a revised date. Continued use of our website or services after changes constitutes acceptance of the updated terms.
